MEMBERSHIP TERMS AND CONDITIONS

1.1 Introduction
The Oriental Group of Restaurants (“Oriental Group”) would like to offer our privileged customers news and information regarding our products and services, including promotions, special offers and discounts.  We are offering you the opportunity to become a member of the Oriental Cuisine Club (a "Member") to enjoy special privileges that Oriental Group may offer from time to time.

1.2 Collection and use of personal data
If you become a Member, you will need to provide Oriental Group certain personal information (including your name and contact details such as email address and mobile number).  You will need to provide us with your mobile number and email address for us to identify you as your mobile number will be your username or unique identifier as a member of Oriental Cuisine Club. Any personal data held by us about you will be held in accordance with our Privacy Policy (available here: LINK TO PRIVACY POLICY).

1.3 Direct marketing
By clicking on the "SUBMIT" button, you agree that Oriental Group, our affiliates, related entities, and third parties acting on our behalf ("Business Partners"), may collect, use and disclose your personal data, which you have provided at the member's portal at https://members.orientalrestaurants.com.my (the "member's Portal"), for providing marketing material that you have agreed to receive, in accordance with the Personal Data Protection Notice 2010 and Privacy Policy (available here: LINK TO PRIVACY POLICY). Please note that marketing material may be sent directly by our Business Partners, and we may disclose your personal data to them for that purpose.

1.4 Membership Tiers

1.4.1 Gold Tier
As a Member you will be required to provide your mobile number, among other information we may require from you, in order to take advantage of special promotions and discounts offered to Members. This may be required online or by our restaurant staff depending on the circumstances.
If you sign up at the point of sale at one of our outlets, you will enter the Gold Tier. As a Gold Tier member, you will qualify for a RM50 Welcome e-voucher (valid for 3 months) and one Teochew Spicy Sauce Set e-voucher. In order to further qualify for another RM50 Welcome e-voucher (valid for 3 months) and one RM 100 Birthday e-voucher (available once per membership year with a minimum spending of RM 200 per transaction [before government taxes & service charge]) valid for use by the Member only on the Member’s birthday month, Members will have to provide further details on the Member’s Portal.

If you sign up at the point of sale at one of our outlets, you will enter the Gold Tier. As a Gold Tier member, you will qualify for 2 x RM50 Welcome e-vouchers (valid for 3 months), 1 x Teochew Spicy Sauce Set e-voucher and 1 x RM 100 Birthday e-voucher (available once per membership year with a minimum spending of RM 200 per transaction [before SST & service charge]) and valid for use by the Member only on the Member’s birthday month).

Please note that these special privileges only apply to new Member sign-ups.
For membership renewal of a new membership cycle, you are required to pay RM 98. In your new membership cycle, you will receive 1 x RM 50 Renewal e-voucher, 1 x RM 78 Renewal e-voucher and 1 x RM 100 Birthday e-voucher.

1.4.2 Platinum Tier
Upon achieving spend of RM 20,000 and above, you will be automatically upgraded to the Platinum Tier. As a Platinum Tier member, you will enjoy all the benefits of the Gold Tier, plus three RM 100 Cash e-voucher, two 3-head Abalone e-voucher, one Premium Longevity Birthday Bun Set e-voucher, priority for VIP rooms booking and unlimited corkage waiver.
During the respective seasonal festive periods, you will be entitled to one Premium Japanese Dried Scallop Dumpling Set e-voucher and one White Lotus Paste with Single Egg Yolk Mooncake Set e-voucher.

Members should refer to the Member’s Portal for the latest privileges. Please note that Oriental Group reserves the right to amend these privileges at any time.

Note: If you are a member of our previous membership program, Platinum Special tier is introduced for a limited period* only where members is required to register to be a Gold member and be upgraded to Platinum Special (earning of points like a Platinum member). Platinum Special tier is only available for a maximum of one membership year.

1.5 Amending personal data and terminating membership
You may amend your personal data or marketing preferences at any time via our Member’s Portal. You will need to inform us in writing at club@orientalrestaurants.com.my should you choose to terminate your membership. Please allow a few working days for changes to take effect.Kindly be advised that there will be no refunds made and/or early issuance of any unused e-vouchers at the point of termination. Alternatively, your membership will automatically expire upon non-renewal of membership, and all balance Oriental Ringgit and/or unused e-vouchers will be deemed forfeited.

1.6 Members’ Portal
If you access our member’s portal to make changes to your personal data or otherwise, such use is governed by our members’ portal Terms of Use.

1.7 Membership validity
Membership is valid for one (1) year from the date of application with extension till the last day of the month in which the said one (1) year period ends. For example, Members that sign up on 2 September 2018 will have their membership valid until 30 September 2019. This membership is only valid at participating Oriental Group restaurants in Malaysia. Please refer to the Member’s Portal for the list of participating restaurants.
Membership is strictly non-transferable and shall only be enjoyed by the Member in person.

1.8 Earning and expiry of Oriental Ringgit (OR)
As a Gold member, Oriental Ringgit 1 (OR1) points will be awarded for every RM10* spent at any participating Oriental Group restaurants.
As a Platinum member/Platinum Special, Oriental Ringgit 1.2 (OR1.2) points will be awarded for every RM10* spent at any participating Oriental Group restaurants (*excluding event/wedding packages, promotional items, set menus, food tasting, deposits and before SST & service charge).
Member must be physically present (proof of identification required – full name as per NRIC during sign up) at the point of dining. Combining multiple membership accounts or splitting the bill to earn OR is strictly not allowed.

In the event network is down, points will be updated within 3 working days.

OR points accrued shall expire upon expiry of Membership. Upon renewal of membership, any Oriental Ringgit points accrued shall be brought forward to the next membership year with a grace period of 3 months and must be converted to cash e-voucher within grace period, otherwise deemed forfeited.
The system may require up to one (1) working day to reflect the transactions, e-vouchers and earned OR.

1.9 Redemption of Oriental Ringgit (OR)
Member must be present (proof of identification required – full name as per NRIC during sign up) at point of dining in order to redeem any membership privileges. Member is required to sign off on the receipt to acknowledge the redemption(s) made. For every OR50 points earned, Member will receive a RM 50 cash e-voucher, valid for 6 months from date of issue and valid for use within membership period only. The cash e-voucher can be used to offset bill when dining at any participating Oriental Group restaurants. Combining multiple membership accounts or splitting the bill to redeem membership privileges is not allowed.

1.10 Termination and cancellation
We reserve the right to terminate the Member's membership if the membership account is found to be shared with another non-Member.
We reserve the right to terminate your membership, in our absolute discretion, should you abuse any of the conditions and privileges bestowed on you as a Member.

1.11 Membership upgrade and downgrade
Members will be automatically upgraded upon achieving the minimum spend required for the Platinum Tiers. The system will require (1) working day to reflect the upgrade and accompanying privileges (e.g. e-vouchers).
Members will also be automatically downgraded should they fail to maintain the minimum spend threshold for their Tier category. For example, a Platinum Tier member will be downgraded to a Gold Tier should their spend for the membership year is below RM 20,000.

2. Law and forum
This Membership Agreement is governed by and construed in accordance with the laws of Malaysia.
Any dispute or claim arising out of or in connection with this Membership Agreement, (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of Malaysia courts.

3. Consent 
I would like to join the Oriental Group Membership club and I consent you to holding my personal data in accordance with your Privacy Policy.


PRIVACY NOTICE

1. Introduction
The Oriental Group of Restaurants("Oriental Group", "us", "we") is committed to protect the privacy of visitors to this website (the "Website"). This Privacy Notice sets out how Oriental Group collects, uses or discloses personal data that you have provided to us through the members’ portal. By visiting the members’ portal you are accepting and consenting to the collection, use and disclosure of personal data described in this Privacy Notice. If you do not agree with this Privacy Notice, please do not use the members’ portal. This Privacy Notice does not apply to other websites to which we link ("Third Party Website" or "Third Party Websites"). 
Maintaining the privacy of our customers’ information is important to us. We do not disclose, rent or sell our customers’ personal data to third parties.

2. Collection and use of personal data
We collect the following personal data when you register as a member of the Oriental Cuisine Club at our restaurants or through the members’ portal

  • email address
  • your name, address and mobile number; and
  • any other personal data provided to us when you submit any comment, question or feedback to us, request services from us, or disclose your personal data to us in any way

We use your personal data for the following purposes:

  • to facilitate your registration;
  • to provide services to you;
  • to fulfil your order and deliver it to you;
  • to facilitate and track your purchases from us;
  • to provide you with marketing and other information about our products (including promotions and special offers);
  • to provide you with service support;
  • respond to comments, queries and feedback;
  • provide you with marketing and promotional material if you have opted to receive it; and

Additionally, through the members’ portal, we may automatically gather certain aggregated and anonymous information about the use of the members’ portal, such as how frequently certain areas of the members’ portal are visited, including through the use of cookies, web beacons, Google Analytics and other technologies.

We may use cookies, web beacons, Google Analytics and other technologies for the following purposes:

  • to identify the causes of problems arising at web servers and to resolve these problems;
  • to improve the contents of the members’ portal;
  • to customize the content of the members’ portal and our emails to suit your individual interests or purposes and selectively display best-matched pages to you, including tracking your past purchases in order to provide you with new services or special promotions;
  • to utilize your browsing history on the members’ portal for demographic research; and
  • to obtain static data of portal visitors and aggregated portal visitation statistics which are anonymous in nature.

You may reject our use of cookies by configuring your browser to disable the use of cookies. However, you may no longer be able to receive services or personalized features of the Website which rely on the use of cookies.


3. Disclosures of personal data to third parties
In order to provide services to you, we may disclose, transfer out of Malaysia, your personal data as described in this Privacy Notice:

  • We may permit certain trusted third parties to access your personal data in connection with their performance of services to maintain and operate the members’ portal and certain features on the members’ portal. For example, we may use third parties to host the members’ portal; operate various features available on the members’ portal; send emails; analyze data; provide search results and links and assist in fulfilling your orders and may share personal data or other information with our parent, subsidiaries, divisions, and affiliates.
  • We may employ a third-party service to collect the above-mentioned information, including personal data, and use their tracking services on our behalf. However, this information is strictly confidential and will not be shared with others.
  • We may disclose personal data as an asset in connection with a proposed or actual merger or sale (including any disclosures made as part of an insolvency or bankruptcy proceeding) involving all or part of our business or as part of a corporate reorganization, stock sale or other change in control.
  • We reserve the right to disclose information, including personal data, in order to comply with a subpoena, court order, administrative or governmental order, or any other requirement of law, or when we, in our sole discretion, believe it is necessary in order to protect our rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk reduction. We may also disclose or transfer personal data as otherwise permitted or required by law.
  • We may disclose aggregated and anonymized data to third parties.

Your personal data may be transferred out of Malaysia from time to time. Such transfers will be carried out in accordance with the Malaysia Personal Data Protection Act 2010. Third parties, with the exception of Malaysia public agencies, are subject to data protection obligations and may only use your personal data to perform the necessary functions.

4. How we protect your information 
We are committed to protecting the information we receive from you. We adopt reasonable physical, technical and administrative practices to help protect the confidentiality, security and integrity of data, including personal data, stored on our system. We believe the measures we have implemented reduce the likelihood of security problems to a level appropriate to the type of data involved. Although we take reasonable steps to protect the information we receive from you, no computer system is completely secure and we cannot be held liable for any loss you may suffer for unauthorized access or loss of any data provided to the members’ portal.

5. Links to third party sites
The members’ portal may contain links to third party websites and microsites, including third party payment gateways, whose privacy practices may differ from those of ours. If you submit personal data, including payment information, to any of those websites, that personal data is not subject to this Privacy Notice and will be subject to the third party's privacy practices instead.
We therefore encourage you to review the privacy statement of any website you visit. By clicking on or activating such links and leaving the members’ portal, we can no longer exercise control over any data or information which you give to any other entity after leaving the members’ portal, and any access to such other websites is entirely at your own risk.

6. Accessing and correcting your personal data
You may review and correct your personal data by signing into your user account and updating your personal data, or by contacting our Data Protection Officer ("DPO").  We will only disclose personal data in accordance with an access request to the individual who registered his/her personal data with the members’ portal, and only after confirming that the person requesting access is indeed the registered party.
You may also contact our DPO to withdraw your consent to our use of your personal data.
Please allow ten (10) working days for your request to be processed.

7. Retention of information
Your personal data will be retained for as long as it is necessary to fulfil the purposes for which it was collected or for business or legal purposes, or in accordance with applicable laws.
If you withdraw your consent to our collection, use or disclosure of your personal data, we may not be able to provide you with services that require such personal data. Please also note that your personal data may still be retained on our database to the extent permitted by law.

If we decide to change our Privacy Notice for the members’ portal, we will post the revised Privacy Notice here and, if appropriate, notify you by email. Please check back frequently to see any updates or changes to our Privacy Notice.

1.4 会员籍等级

1.4.1 金卡
作为会员,您将需要提供您的手机电话号码以及我们可能要求您提供的其他信息,以便享有我们向会员提供的特别促销和折扣。有赖于情况而定,有关资料可通过网站或由我们的酒楼职员向您索取。
如果您在我们的其中一间酒楼注册成为会员,您将成为我们的金卡会员。作为金卡会员,您将获得两张价值RM 50的欢迎电子礼券(有效期为3个月)、一张潮州辣酱套装的电子礼券和一张RM 100的生日电子礼券(会员籍周期内仅发出一张,每次RM 200的最低消费必须符合加入政府税与消费税之前,会员只可于会员生日当月使用)。

请注意的是,这些特别优惠仅适用于新的会员注册。
对于新会员籍周期的会员更新,您需要支付RM 98。在您的新会员籍周期内,您将收到一张RM 50更新电子礼券、一张RM 78更新电子礼券及一张RM 100生日电子礼券。

1.4.2 白金卡
达到RM 20,000及以上的消费后,您将自动获得升级成为白金卡会员。身为白金卡会员,您将享有金卡会员的所有优惠,加上三张RM 100的现金电子礼券、两张三头鲍鱼电子礼券、一张生日寿桃电子礼券、优先预订VIP房间和无限量开瓶费豁免。另外,在特定节庆期间,您将有权享用一份日本瑶柱裹蒸粽的电子礼券和一盒白莲蓉单黄月饼的电子礼券。
会员可在会员门户网站查询最新的优惠。请留意,港城集团保留在任何时候修改这些优惠的权利。

注意:特别白金卡只在有限的时间内推出*如果您是我们旧会员计划的会员,必须重新申请成为金卡会员,并升级为特别白金卡(赚取和白金卡会员一样的积分)。特别白金卡会员籍最多只能使用一年。

1.5 修改个人信息和终止会员籍
您可通过我们的会员门户网站随时更改您的个人资料或行销偏好。若您欲终止您的会员籍,请通过club@orientalrestaurants.com.my 以书面形式通知我们。请允许数个工作天的时间让更改生效。请留意的是,我们将不会在您终止会员籍时进行退款和/或提前发放任何未使用的电子礼券。或者,您的会员籍将在沒有获得更新的情况下自动失效,而所有剩余的Oriental Ringgit和/或未使用的电子礼券将被视为失效。

1.6 会员网站
若您访问我们的会员网站以更改您的个人资料,则此类使用受我们会员网站的使用条款约束。

1.7 会员籍的有效性
会员籍的有效期是从注册日期算起的一年期限,至届满当月的最后一天。举个例子,于2018年9月2日注册的会员,其会员资格的有效期是到2019年的9月30日。此会员籍仅适用于马来西亚港城饮食业集团旗下的参与酒楼。请参阅会员门户网站,以获知参与酒楼的名单。会员籍不可转让,只供会员亲自享用。

1.8 Oriental Ringgit (OR)的赚取和到期
在港城集团旗下任何参与的酒楼,金卡会员每消费RM10您将获得一个Oriental Ringgit 1(OR1)积分,白金卡会员/特别白金卡会员每消费RM10您将获得一个Oriental Ringgit 1.2(OR1.2)积分。(不包括活动/婚宴配套、促销品、套餐、试菜、订金和加入政府税与消费税之前)。会员必须亲临用餐地点(我们将按照会员身份证上的全名确认其身份)。会员不允许合并多个会员帐户或分割帐单以赚取OR积分。

若网络故障,积分将会在3个工作日内更新。

累积的OR积分将在会员籍届满时到期。若会员籍获得更新,累积的积分可结转到下一年的会员籍,但需要符合3个月的宽限期;同时必须在宽限期内转为现金电子礼券,否则将被视为失效。

系统或需要一个工作日以反映相关交易,电子礼券和所赚取的OR积分。

1.9 Oriental Ringgit (OR)的兑换
会员必须亲临用餐地点以兑换任何会员特权/优惠,我们将按照会员身份证上的全名确认其身份。会员也需要在收据上签字以确认所进行的兑换。每赚取OR50,会员将自动获得自发出日期起有效期为6个月的RM 50电子现金礼券,并仅可在会员籍期限内有效使用。当在任何参与的港城集团酒楼用餐时,电子现金礼券可用于抵扣账单。尽管如此,会员不允许合并多个会员账户或分割账单以兑换会员权限。

1.10 终止和取消
若会员账户被发现与非会员分享,我们将保留终止该会员的会员籍之权利。
若您滥用授予您的任何会员特权和优惠,我们保留绝对酌情权以终止您的会员资格。

1.11 会员资格的升级与降级
一旦达到白金卡所要求的最低消费后,会员将自动获得升级。系统将需要一个工作日来反映有关升级和伴随附送的优惠(如电子礼券)。不过,如果会员无法保持其会员等级的最低消费,其会员资格将自动被降级。举个例子,一名白金卡会员若在会员籍年份内的消费不超過RM 20,000,那其将被降级为金卡会员。

2. 审判地法律
此会员协议由马来西亚法律管辖并按其诠释。因此会员协议引起或与之相关的任何争议或索赔(包括非合同纠纷或索赔)均受马来西亚法院的专属管辖。

3. 同意 
我愿意加入港城集团的会员俱乐部,并同意根据贵方的隐私政策让贵方持有我的个人资料。

The Oriental Group of Restaurants including Oriental Pavilion, Oriental Treasure, Noble House, Noble Mansion, Noble Banquet, The Ming Room, The Han Room, Tang Room, Oriental Seafood and Maju Palace (collectively referred to as “we”, “us”, “our”) respects and is committed to the protection of your personal data and your privacy. This Personal Data Protection Notice (“Notice”) explains how we collect and handle your personal data in accordance with the Malaysian Personal Data Protection Act 2010 (“Act”). Please note that we may amend this Notice at any time without prior notice and any such amendment will be notified via our website or by email.

(1) Personal Data

1.1 Type of personal data

Personal data means any information which relates to you and which was collected or provided to us for the purposes stated in Section (2) below.

Personal data may include your

● Contact details (including mobile number and e-mail address)

● Information in audio and/or video format (including voice, video recording, closed-circuit television (“CCTV”) or security recording)

● when you register for our Oriental Cuisine Club loyalty membership either online or at our participating restaurants;

● when you contact us directly online or physically upon enquiry of our products and / or services;

● through third parties such as our business partners;

● through cookies from the use of our website.

All provision of personal data is on a voluntary basis. However, if you decide not to provide us with any of your personal data, we may not be able to provide you with the products / services requested.

(2) Purposes for collecting and processing your personal data

Your personal data is collected and further processed as required or permitted by law and to give effect to your requested commercial transactions, including the following:

● to process your request for our products and / or services, such as reservations at one of our restaurants;

● to contact you regarding our latest product / services information, upcoming events, promotions, advertising, marketing and commercial materials which we feel may interest you upon your request;

● for our internal records management;

● to carry out market analysis and research and customer profiling to gauge the market trends;

● to provide you with customer support;

● to ensure that the content of our website is presented in the most effective manner for you and for your computer and / or device; and

● for internal investigations, audit or security purposes.

We will only keep your Personal Data for as long as is necessary to meet the purposes outlined above.

● government departments or agencies, statutory authorities and industry regulators, as and when required or authorized by law;

● third parties appointed by us to provide services to us or on our behalf (such as auditor, lawyer, company secretary, service providers, printing companies, telecommunications company and contractors).

4.1 Links to other sites

Our websites may contain links to other websites not related to the Oriental Group of Restaurants and we therefore assume no responsibility for the contents or the privacy policies and practices on those websites. We encourage all users to read the privacy statements of those sites, as their privacy practices may differ from those of the Oriental Group of Restaurants.

(6) Further rights of data subjects in the European Union ("EU")

If you are a data subject in the EU, you may contact us to exercise the following further rights:

● request for the erasure of your Personal Data;

● request for the restriction of processing of your Personal Data;

● object to the processing of your Personal Data; and/or

All requests made to us in exercising the rights above will be processed within a reasonable time except where we refuse such requests in accordance with any applicable laws or regulations.

We may amend this Policy (including the Cookies Policy) from time to time. The updated versions will be posted on our Platforms and date stamped so that you are aware of when the Policy was last updated. You have the right to access and correct your personal data held by us. We will make every endeavour to ensure your personal data is accurate and up-to-date therefore you can log in to your account via the members’ portal to update your personal data.

In the event of any conflict between this English language Personal Data Protection Notice and its corresponding Bahasa Malaysia Personal Data Protection Notice, the terms in this English language Notice shall prevail.
